Note: The following contains spoilers if you have not seen Season 16, Episode 5 of ABC's "The Bachelor."

Buenos d?as, "Bachelor" fans! Week five finds us in beautiful Puerto Rico where Ben is going above and beyond to prove that he is ready to find love while wearing only henley shirts from the cool side of the color wheel. In this episode, we were reminded that black underwear shows through white linen pants, all life's goals can be accomplished by the age of 24 and contrary to popular belief, courtesy of "A League Of Their Own" ... there is crying in baseball. I've narrowed the brutal two-hour beating of a show into six memorable one liners that will help you navigate all "The Bachelor"-related topics of conversation of the day. You're welcome.

Most Memorable One-Liners:

1. "It's raining gatos." -- Ben
Ben and Nicki were caught in what could have possibly been the early stages of a tropical storm during their one-on-one date. Since Ben is super witty and moderately skilled in conversational Spanish, he zinged the audience by declaring that it was raining "gatos." I was unsure why it was only raining cats instead of cats and dogs, but whatever. The point is that the two were soaked to the bone and Ben's hair never looked better. One can only assume that Mother Nature was horrified by Nicki's toga-inspired dress that was more than likely purchased from the naughty Cesar section at Party City and she unleashed all her powers on the entire country so Ben had no other choice but to stop at a local shop for them to change into dry clothes. I bet Mother Nature's head was shaking in disbelief when Nicki decided to tie a table cloth around her neck and call it a dress and Ben showed up wearing white linen from head to toe, including a fedora. Ol?!

2. "COME ON, B!TCHE$!!!" -- Kacie B.
Who knew that Kacie B. was such a competitor? She's a machine on the baseball diamond with a glove as well as the 50-yard-line with a baton. The group date was split into two baseball teams, each vying for the chance to win a super romantic beach date with our "Bachelor." At first, I was shocked at how many of these women actually hit the ball, but then I saw Ben was the pitcher and he was lobbing them over the plate so slow and arched that my 97-year-old Mimi would have been able to make a connection. Apparently, the game was a nail-biter and Kacie's battle cry for her fellow red teammates was the ever popular and dainty, "COME ON, B!TCHE$!" Southern charm at is finest, y'all!

3. "I've pretty much done everything in life that I want to do and I'm tired of being single." -- Elyse
Poor Elyse. After dressing in her most sophisticated "Jersey Shore" outfit, she completely bombs on her one-on-one fancy yacht date. She admits that she's done everything in her life that she can at age 24, and is tired of being single. Obviously, this raises more than one red flag with our Bachelor. "You mean there's nothing else you want to do? You're just here because you're tired of being single?" She answers, "Of course not. I'm here because I'm ready to get married." Party foul, Elyse. Drop and give me 20.

4. "Are you going in the water already nude?" -- Ben
Yes, Ben. Typically when skinny dipping, you go into the water nude. How fortunate that Courtney just happened to be at your hotel door in nothing but a robe so you could check "go skinny dipping with a model" off your leap list? Winner.

5. "Tread lightly. I'm just saying ... be careful." -- Ben
Emily apologizes for last week's outburst about how Courtney is nothing but a poser who is here for the wrong reasons. Ben is happy to hear that she has come to her senses. Emily smiles and then confesses that she still stands by her opinion and then proceeds to talk about Courtney again for another five minutes. Ben becomes frustrated and tells her that she doesn't know anything about the importance of leap lists and how certain things need to be checked off before his 30th birthday so just back off.

6. "Jennifer, I'm sorry. Take a moment to say your goodbyes." -- Chris Harrison
It was probably the most dramatic rose ceremony we've had in a while. All six people watching at my house screamed interjections at the television at Ben's disposal of the coolest girl in the bunch. She had an unfortunate exit interview that included choking sobs peppered with hiccups and bouts of ugly crying that I choose to forget. Such a shame. It looks like I'm rooting for Blakely and her new found epiphany.

Russell Bishop: Soul-Talk: What Can You Do With All That Upset?

How much upset have you experienced in your life so far? How much more upset would you like to endure going forward? Bizarre questions, perhaps, and yet if you are willing to dig into them a bit, you might be able to dig out from under all that hurt and upset in your life.

Undoubtedly, you have experienced all manner of upsets in your life, some that came seemingly out of nowhere, and some that have been of your own making. It's this last statement that some will find even more upsetting, while others will find it liberating. If it's upset you seek, you need read no further, for upset has already been won. As much as you may find it apparently useful to blame me or someone else for your upset, the truth of the matter is that you are the one who authors your own upset.

From Upset to Liberation

If you're not already completely pissed off, let's dig into this notion of how you author your own upset and see if you can discover some keys to your own liberation.

If you're already pissed off, did you start your day off that way before you even began reading this article? Is pissed off your basic stance in life? If so, I actually do understand -- I've spent much of my life angry and upset, blaming circumstances and other people for the things I didn't like in life. Truth be told, there's lots to be pissed off about out there. The only problem with living life through pissed-off eyes is that the only thing you win by remaining upset is the opportunity to be even more upset. Perhaps you've noticed.

If you really want to experience what this is like, just bring to mind something that really pisses you off about another person. Simply dwell on that behavior, attitude or way of being of the other person for a moment and see if you just don't wind up being even more pissed off than you were even five minutes ago. If you're "successful" at getting even more upset, then you may have noticed that the only person who got you upset right now is your own self. Sure, you can blame me for bringing up the subject in the first place, and if that makes you any happier, go right ahead and blame me.

However, blaming me, or anyone else for that matter, is beyond a slippery slope. The more you focus on your object of blame, the more upset you are likely to find yourself. Let's be clear, here: Take a look around wherever you happen to find yourself right now. Am I there? Is the other person there? I didn't think so. The one person who is present, however, is you.

Actually, there are at least two of you present -- your Self-Talk and your Soul-Talk. Your Self-Talk is the one that will keep bringing up even more reasons for you to be upset, and the more reasons you give yourself, the more upset you will become. If you have been following this series on moving from Self-Talk to Soul-Talk, then you will recognize that your Self-Talk is primarily negative and builds on limiting self-images you most likely learned growing up.

The more riled up you manage to get, the more power you are handing over to your Self-Talk. Talk about a vicious circle! What makes this circle ever more vicious is that you can literally turn a mole hill into a mountain by what you tell yourself and wind up actually believing that the other person did this to you.

One Self-Talk limitation most of us learned in massive doses is "I'm upset because..." and then you get to fill in the blank. "I'm upset because..." is a master stroke in blame, a true key in how to live a life filled with hurt and upset.

I doubt seriously that any of you spent late night hours recently plotting for your next upset, or planning your next set of hurt feelings. However, I wouldn't be surprised to learn that at least some of you reading this article did spend some serious time reviewing how upset you are with your boss, husband, wife, kids, next door neighbor, politician or any other object of your upset. If you have, then surely you must recognize that the more time you dwell on what the other person did or said, what they didn't do or didn't say, the more upset you can become.

If you can recognize this simple little fact, then perhaps you can at least own something along the following lines: The more time you spend dwelling on your upset, the more upset you become. "So what?" you might ask. Well, there's a really big "so what" here: Even if the other person did do something unkind, mean-spirited or downright nasty, you're the one adding insult to your own injury. Long after the other person has left, you're the one who insists on dwelling in the negative feelings. You're the one who is adding to your own upset.

Was It Me or Someone Else?

Toward the middle of 2011, I lost one of my key clients, which had a material impact on my work and income. The reason they gave for not continuing turned out to be the very reason they hired me in the first place! The company was trying to grow its book of business and in order to do so needed to add some capability not already in place. Just as we were starting to make some progress in building that capability, the CEO turned his attention to another of his "bright, shiny objects," a patter of distraction that had put the company in the predicament for which I was hired in the first place.

At first, I was thoroughly upset, running the scenario over and over again in my mind, reminding myself how completely stupid this decision was. As I was stewed in my own juices, lamenting the turn of events, one of my mentors and coaches asked me, "When are you going to stop being surprised?" When I asked what the heck she was talking about, she reminded me that I had not been all that thrilled with the direction of this client work in the first place. She then asked me to consider what my Soul-Talk might prefer. I wound up recognizing a deeper level of working with people that I truly wanted but had not been willing to risk going for. From there, I was able to let go of my true source of upset (undermining my own self), and began focusing on that more deeply satisfying and meaningful work.

What makes this all the more interesting is that as I began to take positive steps toward aligning my actions with my "seemingly-impossible good," the very client that had dropped me, came back asking if we could re-engage the conversation but at a deeper level.

That's where true positive thinking comes into play: Once you choose a positive experience that you would like to experience more of, you can then ask of yourself, "What can I do, right now, to begin bringing that 'seemingly-impossible good' into my life?" As I mentioned last week, you probably won't go from zero to hero in one simple miraculous step, but you may put yourself on the path and wind up discovering a whole series of micro steps that will begin leading you into the improved experience of life you truly seek.

States to decide this week on mortgage deal (Reuters)

WASHINGTON/CHARLOTTE (Reuters) ? State and federal officials are close to a settlement with the largest U.S. banks over mortgage abuses, with states facing an end-of-the-week deadline to decide whether they will sign on, people close to the talks said.

The final value of any settlement will depend on which states it includes, and could drop sharply if states like California, one of the hardest hit by the foreclosure crisis, do not join.

In another sign the deal is close, negotiators have overcome a sticking point and agreed on Joseph Smith, North Carolina's banking commissioner, as a monitor to ensure the banks comply with the terms of the settlement, these people said.

Talks have dragged on for more than one year but picked up steam last week as the Obama administration announced a new federal-state working group to investigate misconduct in the pooling and sale of risky home loans, a move that signaled the settlement would only allow banks to put behind them a small slice of misconduct.

The banks in the talks are Bank of America, Wells Fargo & Co, JPMorgan Chase & Co, Citigroup and Ally Financial Inc.

The proposed settlement releases the banks only from civil claims of errors in servicing and originating the loans. Those details have been in place for months, but the launch of the working group, the Obama administration said, makes clear its commitment to continue to investigate misconduct that fueled the financial crisis.

In exchange for up to $25 billion, much in the form of cutting mortgage debt for distressed homeowners, the banks will resolve civil state and federal lawsuits about servicing misconduct and faulty foreclosures, and state lawsuits about how they made some of the loans.

President Barack Obama said in his State of the Union speech last week that he directed his attorney general to create the new working group to "help turn the page on an era of recklessness."

Left-leaning groups including MoveOn.org had decried the proposed settlement as a "sweetheart deal" and criticized the administration for what they said was a failure to bring big-ticket cases against Wall Street banks and individuals who played a role in the 2007-2009 collapse.

The new working group, designed to coordinate investigations into the residential mortgage-backed securities market, potentially gives the administration and dissident states political cover to join the settlement.

CALIFORNIA STILL IN QUESTION

In announcing the new working group, housed within an older financial fraud task force, federal and state officials made clear the settlement would cover misconduct that occurred in the aftermath of the crisis, while the group would focus on wrongdoing that fueled the crisis itself.

The attorney general in New York, Eric Schneiderman, who has been a holdout on the settlement, saying that it released the banks from too many claims, is helping to lead the new group.

In an interview with Reuters on Friday, he said the focus of the settlement had "become narrow enough" to allow a full investigation to go forward, even though he said he was "not yet" ready to sign on.

California has also been reluctant to sign on.

The state's attorney general, Kamala Harris, withdrew from the talks last year amid concerns that the proposed settlement was too lenient, and her spokesman said again last week she believed the settlement remained "inadequate."

But Harris did meet with federal officials last week to press her concerns, people familiar with the matter said, and has not yet officially said her state is out of any final deal.

Separately, Massachusetts filed its own lawsuit against the banks last month, a signal that state may also go its own way in resolving allegations of deceptive foreclosure practices.

States have one week to make a decision, and an announcement of a settlement could come as early as next week, people familiar with the talks said.

The appointment of Joseph Smith as the monitor is also likely to win plaudits.

President Barack Obama nominated Smith, who has long had the respect of both banking executives and consumer advocates, to become the chief regulator of Fannie Mae and Freddie Mac in 2010, but he withdrew from consideration amid objections from Republicans in Congress.

A spokeswoman for Smith said he was unavailable for comment.

The Fujifilm X10 ($599.95 direct) may look like an older camera on the outside, but it's a purely digital point-and-shoot with some nice features that photographers should appreciate. Along with the X100 and recently announced X-Pro1, the camera is part of Fuji's X series?a group of unique cameras that are aimed at enthusiasts. The X10 is set apart from other point-and-shoots by its larger image sensor, bright optical viewfinder, abundant physical controls, and Raw shooting capability. It doesn't manage to oust the Canon PowerShot S100 ($429.99, 4.5 stars) as our Editor's Choice for high-end compacts, but if you're looking for a zooming compact with a good optical viewfinder, the camera is worth consideration.

Design and Features
From a distance, the X10 could easily be mistaken for a 1970s-era 35mm camera. Its all-black finish and optical viewfinder fit the bill, but the camera's disguise is betrayed by the modern rear LCD and an abundance of button and dials. It's a bit larger than most compact cameras, measuring 2.7 by 4.6 by 2.2 inches (HWD) and weighing in at 12.3 ounces. The Panasonic Lumix DMC-LX5 ($499.99, 3.5 stars), which delivers a similar zoom range but lacks an optical finder, is only 2.6 by 4.3 by 1.7 inches and a bit lighter at 9.5 ounces.

Unlike most modern cameras, the X10 lacks a power switch. To turn the camera on, you must remove the lens cap and twist the lens away from its Off position. You also twist the lens to change its focal length?there are no power zoom controls like on other compact cameras. This gives you more control over the zoom action, but also makes the camera a bit awkward to use?especially if you're shooting via the optical viewfinder. Other cameras in this class have optical finders, including the Canon PowerShot G12 ($499.99, 2.5 stars), but they are generally much smaller and don't lend themselves to regular use.

The viewfinder is bright and clear enough for regular use, but it is not without its foibles. It doesn't cover the entirety of the frame, only about 80 percent, so for tightly-composed photos you'll probably want to use the rear LCD. It is also without any sort of information display. There is no focus confirmation, so you'll have to place your trust in the camera's autofocus system. By default, the camera uses a center focusing point, although you can change that manually. If you use something other than center as the point, it's up to you to remember where in the frame the camera is focusing and translate that to a position in the finder.

Placing trust in the autofocus is not something to be worried about?I was able to raise the camera to my eye for quick street shots and the X10 nailed the focus quickly and consistently. There is an option to have the camera make an audible beep when focus is locked, but street shooters are likely to disable this. There is no way to separate the focus confirm beep and the shutter sound clip, which is unfortunate as the desire to have an audible confirmation of focus lock does not go hand-in-hand with that to have the camera play a fake shutter noise when a photo is snapped.

I also found that using the zoom lens and the optical finder together could be a bit awkward. My hand would generally get in the way of the finder when adjusting the focal length, which makes grabbing quick shots difficult. I also inadvertently added fingerprints to the front of the finder when operating the zoom on several occasions, which very noticeably affected its clarity.

The 4x zoom lens is the equivalent of a 28-112mm f/2-2.8 in 35mm photography. It's a very sensible zoom range?although it lacks the telephoto reach needed for sports, birding, and similar applications. Other top-end compacts feature similar zoom ranges and fast lenses, although the Nikon Coolpix P7100 ($499.95, 4 stars) leads the pack with a 7.1x (28-200mm f/2.8-5.6) lens. The camera has a very nice macro mode to allow you to focus on objects that are very close to the lens. Enabling it also enables the rear LCD, as you cannot get accurate framing with the optical finder when shooting on a close object due to parallax. This is true for any camera that has a viewing lens that is offset from its taking lens.

The X10's rear LCD isn't the best in its class. It is 2.8 inches in size, a bit smaller than the 3-inch displays?that are par for the course in this class of camera, but does offer the same 460k dot resolution that is common to the Canon PowerShot S100, Panasonic LX5, and Canon G12. Both the Nikon P7100 and the Samsung TL500 ($449, 3 stars) offer 921k dot screens. The X10's LCD is bright, so you won't have any trouble using it on a sunny day?and the optical finder is there if you're in a situation where glare cannot be avoided?but it's easier to confirm critical focus on a higher-resolution display.

You'll find a number of physical controls on the X10. The top-mounted Mode Dial allows you to toggle between shooting modes, and another dial makes it easy to dial in EV compensation from -2 EV to +2 EV in third-stop increments. The shutter button features a standard thread, which makes it possible to add a soft release button or to use a manually shutter release cable to grab a photo. Rear controls include a 4-Way Command Dial, AE-L/AF-L, and a button to switch from JPG to Raw shooting for a single shot. There is also a standard rear command dial which will adjust aperture in A mode, shutter speed in S mode, and can be used to navigate through menus.

The menu system isn't the most intuitive; in my testing, some of the settings were a bit hard to find. The Raw shooting mode is actually located in the Settings area rather than the Shooting Menu where I'm used to seeing it. Once the initial setup is complete you won't have to spend a lot of time diving into menus?there are enough physical controls so you can avoid that. The X10 also supports a few film emulation modes, including Provia, Velvia, and Astia film stocks as well as a few different black and white shooting modes.

Even though the 2/3-inch image sensor in the X10 is larger than those found in most point-and-shoots, it is smaller than that found in interchangeable lens cameras like the Nikon J1 ($649.95, 3.5 stars), Olympus E-PM1 ($499.99, 4 stars), and our Editors' Choice, the Sony Alpha NEX-C3 ($649.99, 4.5 stars)?all of which are similarly priced to the X10. The main reason to opt for a compact over one of these mirrorless shooters is portability. Larger lenses are required to capture enough light to cover larger image sensors, where a compact camera like the X10 is able to get the job done with a much smaller lens. Canon's recently announced G1 X ($799.99) is set to change this a bit, as its sensor is larger than that of a Micro Four Thirds camera, but the camera itself is only slightly larger than the X10.

Study Shows Inverse Link Between Brain Games and Alzheimer's Disease (ContributorNetwork)

A clinical study published Monday in the online edition of the Archives of Neurology is the first of its kind to link participation in reading, brain games and writing with a decreased production of a special protein whose presence has been linked to Alzheimer's disease.

Synopsis of Clinical Study

Three groups of study participants were observed and tested periodically over a five year period: Group One: 65 healthy individuals, mean age of 76.1 years; Group Two: 10 individuals diagnosed with Alzheimer's disease; and Group Three: The control group, 11 individuals with a mean age of 24.5 years, as noted in the Archives of Neurology.

Conclusions reached by the study panel were that people who were involved in the greatest levels of cognitive activities in the early and middle parts of their lifespans were the least likely to have the brain deposits of amyloid.

Although the physical activity of the participants were not observed during this study, researchers inferred that many people who choose a lifestyle involving cognitive activities also participate in a lifestyle that includes physical activity. Based on this inference, researchers extrapolated that both cognitive and physical activity throughout the lifespan contribute to fewer deposits of amyloid in the brain.

Acceptance of Amyloid Deposits in Brain Being Associated with Alzheimer's Disease

A study published June 2011 in the Annals of Neurology speaks to the association of amyloid deposits in the brain, along with subsequent atrophy, in Alzheimer's disease. Study authors noted that the deposits and some brain atrophy were present even before cognitive symptoms such as memory loss are evident.

The Alzheimer's Association published an entry commenting on the validity of this study, commenting that it was well conducted and controlled research using the most up-to-date techniques in brain imaging. The association concurred with the findings.

Known Prevention and Treatment of Amyloid Brain Deposits

MedlinePlus, a service of the U.S. National Institutes of Health, explains that the cause of amyloid brain deposits is unknown -- as well as the treatment of the deposits. Until future research can reveal more information in this area, the current findings that point to cognitive and physical activity as ways to stave off these protein deposits provide an avenue of hope.

What This Study Means to Baby Boomers

As ABCNews.com reports, Alzheimer's disease is the most common form of dementia after age 60. Although not conclusively proven, it is currently thought that amyloid deposits in the brain lead to the development of the dreaded disease.

While baby boomers and their seniors cannot turn back the clock to change lifestyle factors in their early lives, they can make lifestyle choices now -- to participate in cognitive activities such as reading, writing and playing various games and to participate in regular physical activity -- that may decrease their chances of developing Alzheimer's disease.

Tech stocks subsector face growing competition from mobile phones and tablets. But one tech stocks analysts sees up to 20 percent revenue growth in 2012 for makers of handheld game consoles.?

The market for handheld devices may be getting squeezed by competition from mobile gaming platforms like smartphones and tablet PCs, but research firm International Data Corporation (IDC) is predicting further growth for the sector and expects revenues to jump as much as 20 percent this year, after single-digit percentage growth in 2011.

According to IDC's research manager for gaming Lewis Ward, the experience that comes from playing handheld devices is unique to users, and adds that the short battery lifespan in mobile gaming devices will always give its handheld console rivals an edge.

?"I think the stereoscopic 3D effect [in handheld devices] is quite compelling in many respects," Ward told CNBC on Thursday. ?Obviously Nintendo has some extraordinary IP, Pokemon, and many other titles which are unique to the platform and therefore provides an experience you simply can't get somewhere else.?

??One of the important drivers for adult gamers in particular is the ability to save your battery life on your cellphone and therefore make a dedicated handheld that much more attractive,? he added.

?A recent report from IDC projects the share of video gaming revenue for handheld console devices and their related software will fall to 59 percent in 2015, compared to the current 66 percent, as more users shift to the mobile gaming platform. Even so, Ward is predicting growth for the sector.

?"I'm anticipating growth in dedicated handhelds and console gaming in 2012," Ward said. "The market has been going sideways in many respects for the past couple of years, but I'm expecting some respectable results in the fourth quarter from major providers."?

?Tech heavyweight?Microsoft?beat analyst expectations in its fourth quarter earnings last week, helped by strong sales of its Xbox consoles.?Sony, which reports next week, is expected to barely break even in the lucrative October-December quarter, although Ward expects its handheld gaming unit do well this year when its latest PlayStation Vita console rolls out in the American and European markets in February.

Gaming giant?Nintendo, meanwhile,?forecasts a $580 million operating loss for the full year to March 31, after posting a 61 percent drop in third quarter operating profit?on Thursday. The company also cut its forecast for its latest 3DS handheld console to 14 million units from 16 million after poor sales.

?While investors have questioned the outlook for Nintendo on reports its chief gaming architect Shigeru Miyamoto is stepping down, Ward says the concerns are overblown.

??My understanding is that there's been a lot of grooming going on over the years and there's a lot of very talented people within Nintendo and I fully expect that the legacy will continue. I believe its in good hands in many respects,? he noted.

(AP) ? German Chancellor Angela Merkel expressed determination Wednesday to solve Europe's debt crisis through greater political unity, but dashed hopes of a big injection of money for the region's bailout fund.

Urging the European Union to act more like a central government for the region, she acknowledged that the countries that share the euro don't have the "political structures" to make the common currency work properly.

She spoke at the opening of the World Economic Forum in Davos, where members of the global business and political elite are looking to Germany to prevent a breakup of the euro, which could hurt the economy worldwide. Many participants said they see increasing evidence that Merkel will do so.

"The message is that we are ready for more commitment. We are no longer making excuses ... That is important because otherwise we will continue to lose credibility," Merkel said.

She said the euro's shortcomings "arose over years, so they can't be overcome in one fell swoop."

"It will take time to overcome these shortcomings," she added, "but we are determined to do this."

Merkel did not immediately elaborate on how that would happen, but appeared to rule out one solution that some leading figures have called for ? a big boost to the eurozone's rescue pot created to help weaker eurozone nations struggling with debts.

"We guarantee the euro, but what we don't want is to promise something we can't hold to," she said.

Germany has said it does not currently see any need to increase the region's long-term bailout fund, the European Stability Mechanism, but has noted that European leaders already agreed to review the fund's size in March.

Merkel acknowledged that the 17 nations that use the euro are not tied together enough politically.

"We have taken some steps closer to a fiscal union," she said. "But we can get faster, gain speed and become more decisive."

Overall, she sought to strike an optimistic tone, despite the pessimism that haunts some of the Davos participants amid worries over Europe and a looming slowdown in developed economies.

"Europe will become more attractive (for foreign investors) once we've got through this euro crisis, and I'm sure that we will get through it," she said.

U.S. Marine tells court he is sorry for Iraq killings (Reuters)

CAMP PENDLETON, Calif. (Reuters) ? A U.S. Marine accused of leading a 2005 massacre of 24 civilians in the Iraqi city of Haditha was spared jail time when he was sentenced on Tuesday for his role in killings that brought international condemnation on U.S. troops.

The harshest penalty Staff Sergeant Frank Wuterich, 31, now faces for his guilty plea on Monday to a single count of dereliction of duty is a demotion to the rank of private, the lowest rank in the service, as recommended by a military judge.

More serious charges of involuntary manslaughter and aggravated assault were dismissed as part of a plea deal that cut short Wuterich's court-martial and was decried by a victim's relative as a disgrace.

The outcome appeared certain to stoke outrage among Iraqis, adding to anger over other abuses by U.S. soldiers or contractors, including the 2004 Abu Ghraib prison scandal, during the more than eight years troops spent in Iraq since the U.S.-led invasion that toppled Saddam Hussein in 2003.

Even before it became clear that Wuterich would be spared jail time, the head of the Iraqi parliament's human rights committee, Saleem al-Jubouri, said terms of the deal were "a violation of Iraqis' dignity" and vowed to convene his panel on Wednesday to discuss the matter.

Wuterich, who could have faced a maximum penalty of three months in jail after pleading guilty, showed no emotion as a military judge pronounced his sentence.

But in a pre-sentencing statement he read in court earlier in the day, Wuterich expressed remorse for the slayings and said he realized that his name would always be associated with "being a cold-blooded baby-killer, an out-of-control monster."

Wuterich was accused of being the ringleader in a series of shootings and grenade attacks on November 19, 2005, that left two dozen civilians dead in Haditha, a city west of Baghdad that was then an insurgent hotspot.

The killings were portrayed by Iraqi witnesses and military prosecutors as a massacre of unarmed civilians -- men, women and children -- carried out by Marines in anger after a member of their unit was killed by a roadside bomb.

As part of his guilty plea, Wuterich accepted responsibility for giving negligent verbal instructions to the Marines under his command when he told them to "shoot first and ask questions later," orders that resulted in the deaths of civilians.

Wuterich, in his pre-sentencing statement, said that when he gave that order, "the intent wasn't that they should shoot civilians. It was that they would not hesitate in the face of the enemy."

He said that he and his fellow Marines behaved honorably under extreme circumstances, and that he "never fired my weapon at any women or children that day."

A final decision on a demotion of rank for Wuterich is up to the commander of the Marine Corps Forces Central Command, Lieutenant General Thomas Waldhauser, who had ruled out any confinement as part of the punishment.

Any discharge process faced by Wuterich, a father of three girls, will be separate from his sentencing.

OUTRAGE IN IRAQ

Even before sentencing, word of a plea deal that carried a maximum jail term of three months ignited anger in Iraq, where Ali Badr, a Haditha resident and relative of one of the victims, called it "solid proof that the Americans don't respect human rights."

"This is not a traffic felony," said Khalid Salman, a lawyer for the Haditha victims' relatives and a cousin of one of those killed, expressing his shock at the plea ahead of sentencing.

Six of the seven other Marines originally accused in the case had previously had their charges dismissed by military judges, while another was cleared of criminal wrongdoing.

Defense lawyers argued the deaths resulted from a fast-moving combat situation in which the Marines believed they were under enemy fire.

Wuterich, in his statement on Tuesday, directed an apology to family members of those killed in Iraq, but said civilians were not singled out for attack.

"Words cannot express my sorrow for the loss of your loved ones," he said. "The truth is, I don't believe anyone in my squad ... behaved in any way that was dishonorable or contrary to the highest ideals that we all live by as Marines."

"But even with the best intentions, sometimes combat actions can cause tragic results," he added, reading calmly and deliberately.

Jeffrey Dinsmore, an intelligence officer with Wuterich's battalion at the time of the killings, testified on Tuesday that "insurgent groups ... had complete control over the city (of Haditha) at the time" and the unit had received word that an ambush was likely.

He said insurgents were known to commandeer homes as places to launch attacks and to deliberately use civilians as human shields.

Wuterich enlisted in the Marines after his 1998 graduation from high school, where he was an athletic honor-roll student and played with the marching band. He was serving his second tour of duty in Iraq when the Haditha incident occurred.

Senate Democrats promise to push Obama tax agenda (AP)

WASHINGTON ? President Barack Obama's Democratic allies in the Senate promised Wednesday to press ahead this year with legislation drawn from his plans to require millionaires to pay at least 30 percent in taxes and curb tax preferences for companies that ship jobs overseas.

Senate Democratic leaders promise votes soon on such tax "fairness" initiatives, which were a key theme of Obama's State of the Union address Tuesday night. They include the so-called Buffett rule, named after a recommendation by billionaire financier Warren Buffett ? who benefits from a low 15 percent tax rate on investments ? that he be required to pay a higher rate than his secretary.

The Democratic drive would follow the ongoing push to renew the payroll tax cut, a debate that has broken in Democrats' favor as House-Senate talks began this week. The initiative is laced with politics, coming immediately after GOP presidential candidate Mitt Romney revealed that he pays an effective tax rate of less than 15 percent despite income exceeding $20 million a year.

"The president's blueprint for restoring economic fairness for the middle-class will be the basis of our agenda for this year," said Sen. Chuck Schumer, D-N.Y. Schumer said the decision by Republicans to embrace the payroll tax cut last year despite widespread reservations within the party bodes well for the upcoming debate.

"Don't underestimate our chances of success," Schumer said.

Both Democrats and Republicans embrace the idea of reforming the tax code but they differ over whether it should be done in a way that generates greater overall tax receipts as Democrats demand or whether it should be "revenue neutral" as most Republicans would like.

Among the ideas endorsed by the Democratic leaders Wednesday was Obama's proposal to require millionaires to pay a higher minimum tax rate, deny corporations the ability to completely avoid taxes and reward companies that create jobs in America instead of shipping them overseas.

"Nothing is more important to Congress than reducing income inequality," said Majority Leader Harry Reid, D-Nev.

On a campaign swing in Florida, Newt Gingrich said Obama's proposal for a 30 percent tax rate for millionaires "would be a disaster of the first order."

Added Gingrich: "It would double the capital gains tax. Doubling the capital gains tax would lead to a dramatic decline in the stock market, which would affect every pension fund in the United States."

Researchers at the Stanford University School of Medicine have developed a mathematical algorithm to help predict the severity of bladder cancer.

?

The results were published online Monday, Jan. 16, in the Proceedings of the National Academy of Sciences, and may influence treatment plans for patients with bladder cancer.

?

?There were two main findings,? said Chad Tang, a medical student who contributed to the study. The researchers ?divided up the bladder cancer into different subtypes, which have different prognostic implications. Second, one of the markers they used was a robust predictor of clinical outcomes.?

?

Before applying the algorithm, the team also researched bladder cancer stem cells.

?

?The algorithm was originally published in the context of predicting genes in development and differentiation,? said co-author Debashis Sahoo, instructor at the Pathology Stem Cell Center. ?What we have now is an application to cancer.?

?

The work with the algorithm started approximately two years ago after a 2009 paper identified three different types of bladder cancer: basal, intermediate and differentiated. These subgroups are identified by markers of the keratin (KRT) protein family. The basal subtype is marked by KRT14, intermediate is identified by KRT5 and differentiated is identified by KRT20.

The most severe cases of bladder cancer are consistently related to the basal subgroup. This knowledge will allow doctors to plan the treatment of patients diagnosed with this type of cancer.

?

?The clinician has to remove the bladder in the case of certain patients because of the progress of the cancer, and the way they do it now is based on state and the grade of the cancer, which is very subjective,? Sahoo said. ?This would be the first time that a molecular marker, which is very objective, can guide the clinician.?

?

Removing the bladder is a complicated operation. Markers identified by this algorithm will provide better indication of whether surgery is necessary when compared to traditional methods.

?

?I was motivated to do research where I could use my expertise in computer science to contribute to healthcare, in particular cancer,? Sahoo said. ?Some of the relatives in my family were victims of cancer.?

?

Tang cited intellectual interest as motivating his involvement.

?

?I got involved because I was interested in cancer and biology,? Tang said. ?I knew the post docs pretty well, and I was really interested in stem cell studies.?

?

The study will motivate further research on the subject.

?

?So far, breast cancer is the only kind with a similar way of subtyping,? said Keith Chan, assistant professor at the Baylor College of Medicine and a co-author of the 2009 paper. ?Hopefully we can extend it to other types of cancer and provide better prognostic information for the patients.?

?

?The next step is to try to move it to a prospective clinical trial to validate its results,? Chan said. ?The second thing is to try to understand the biology of these cells, so we can target them. That?s what we?re working on right now.?

Court OKs anonymous witnesses at UK media inquiry (AP)

LONDON ? Britain's High Court says reporters can give evidence to a media ethics inquiry anonymously ? rejecting a bid by a newspaper publisher to force them to reveal their names.

Inquiry head Brian Leveson ruled last year that some witnesses could appear anonymously, after he was told that the reporters feared losing their jobs if they were identified.

Associated Newspapers, which publishes the Daily Mail and the Mail on Sunday, challenged the ruling, saying its reputation could be unfairly tarnished by anonymous witnesses.

But three High Court judges dismissed the claim Friday, saying "it is not for the court to micromanage the conduct of the inquiry."

The inquiry is examining the culture and ethics of Britain's press in the wake of the tabloid phone-hacking scandal.

Swag suites abound at the Sundance Film Festival (AP)

PARK CITY, Utah ? Where there are celebrities, there is swag, and the Sundance Film Festival is no exception. Nearly a dozen gift suites opened their doors Friday afternoon along the city's Main Street.

Kate Bosworth, Andy Samberg, Emma Roberts and Rashida Jones are among the famous folks who stopped by the VEVO PowerStation SOREL Suite, where they could indulge in moisturizing facials and lip treatments from Fresh cosmetics and outfit their feet in snow-ready footwear.

"I think we belong here," said Kimberly Barta, global brand director for SOREL snow boots. "It just makes sense."

The company is also offering a 24-hour concierge service that will deliver boots around the clock to stars who can't stop by the suite.

At the Alive Expo Green Pavilion, guests could pick up natural skincare products and handmade handbags by Kenyan artisans from Tembo Trading Co.

The Bertolli Meal Soup Chalet served up bowls of hot soup and handed out sunglasses and Lumene skincare products to visitors. Joe Pastorkovich of Lumene said Sundance is the perfect place to introduce the European brand to an American audience.

"We're expanding into the U.S., and our brand connects well to Park City," he said. "It's a good fit because of the naturalness of the product, and we're unpretentious. This festival is about independent film, and we're an independent brand."

Italian shoe company Carlo Pazolini also exhibited (and gifted) its wares at the Sundance fest as a means of expanding its market reach.

"We're a European company launching in the U.S., so we wanted to get our name out there," company executive Jennifer Damiano said from the Miami Oasis suite, where she gave away high-end leather shoes and handbags. Guests at the suite were also treated to gluten-free snacks, hair styling by got2B, and cocktails from DiSaronno and Patron.

The Miami Oasis is just one part of the brand-heavy T-Mobile Village at the Lift, which includes McDonald's McCafe Lounge, the Puma Social Lounge and a temporary Tao nightclub.

Actress Blythe Danner stopped by the Fender Music Lodge, which offered live music and swag including Bear Paw boots and Park Lane jewelry.

Sundance sponsors HP, Acura, Chase Sapphire and the Sundance Channel also hosted suites along Main Street.

Alex Wilson, who produced the VEVO suite, said brands love Sundance because of the concentrated star power and media presence.

"In one location for five days, you can't get any bigger as far as names and exposure," he said. "With the heat of Park City, word travels fast."

And the number of branded suites keeps growing, too, much to the chagrin of Sundance Institute founder Robert Redford. He lamented that the success of the festival has attracted what he calls "leveragers" who muddle its mission of nurturing and celebrating independent film.

"They come in with their own agendas to use the festival to piggyback their agendas," he said. "It's a free country and there's nothing we can do about that ... but we have to work harder and harder to point to the fact that this is about the filmmakers. This is about their work and showing their work to you."

Many of the gift suites will close by Monday. The Sundance Film Festival continues through Jan. 29.

J&J to pay $158 million to settle Texas Risperdal case (Reuters)

AUSTIN, Texas (Reuters) ? Johnson & Johnson said on Thursday it will pay $158 million to settle a Texas lawsuit accusing the drugmaker of improperly marketing its Risperdal anti-psychotic drug to state residents on the Medicaid health program for the poor.

The settlement fully resolves all Risperdal-related claims in Texas, the company said. The agreement is specific to the state of Texas and does not involve other ongoing state or federal Risperdal litigation.

The deal settles claims brought by Texas in 2004 and involves alleged Medicaid overpayments during the years 1994 to 2008 "and will circumvent potentially lengthy and costly appellate activities," according to a statement from J&J's Janssen Pharmaceuticals unit.

The settlement will be paid to the original plaintiff, his attorneys, the state of Texas and the federal government, which provides Medicaid reimbursements, the company said.

The complaint against J&J and several of its units filed in U.S. district court in Texas had alleged company representatives "targeted every level of the Texas Medicaid Program with misrepresentations about the safety, superiority, efficacy, appropriate uses and cost effectiveness of Risperdal."

"Janssen ran amok," Allen Jones, the Pennsylvania-based whistleblower on J&J's marketing practices who was a plaintiff along with state of Texas, told reporters in the Austin courthouse.

"They trashed the Johnson & Johnson credo and they misused Texas and, I believe, well-meaning officials, to further their marketing aims," Jones said. "They subverted science and they induced others to betray the people they were supposed to be taking care of. To me that is reprehensible."

The deal marks the first Risperdal settlement with any U.S. state, Janssen spokeswoman Teresa Mueller said.

J&J's once sterling reputation has been battered in the past two years over quality control problems at several of its plants and manufacturing errors that led to massive recalls of a wide variety of its products, including hip replacements, contact lenses, insulin cartridges and heart devices.

Its biggest black eye came from its McNeil consumer healthcare unit, which in a series recalls was forced to pull hundreds of millions of bottles and packages of popular medicines, such as Children's Tylenol, Motrin, Rolaids and Benadryl.

J&J shares were down 28 cents, or 0.4 percent, at $65 in afternoon trading on the New York Stock Exchange.

NBA: Golden State 105, Cleveland 95

CLEVELAND, Jan. 17 (UPI) -- David Lee poured in 29 points, including seven straight late in the game Tuesday, powering the Golden State Warriors to a 105-95 win over Cleveland.

Golden State trailed 87-85 with 9 minutes remaining when Lee hit a pair of jumpers, scored a close-in basket and added a foul shot to lift the Warriors into the lead for good.

Lee grabbed nine rebounds while Nate Robinson added 17 points and 10 assists as the Warriors won a second straight road game.

Klay Thompson and Brandon Rush contributed 14 points apiece for Golden State.

Cleveland was led by Antawn Jamison's 19 points while Kyrie Irving added 18.

Coalition touts renewable energy for Maine (AP)

AUGUSTA, Maine ? A coalition that's pushing for a referendum to mandate increased use of renewable energy in Maine says its initiative would reduce dependence on foreign oil, strengthen the economy and promote energy efficiency.

The Maine Citizens for Clean Energy held a news conference Wednesday in support of a referendum proposal to require that at least 20 percent of Maine's electricity come from new renewable energy sources by 2020. Leaders of the initiative said they're confident they'll collect more than 57,000 valid signatures needed by the end of January to get the question on the ballot.

Environment Northeast's Maine director, Beth Nagusky, said Wednesday that residential electric bills would rise initially, but then decrease if the measure passes.

Gov. Paul LePage says the initiative would result in increased energy costs.
